Legal aspects of unwanted device explantations: A comment on the patient R case

•Explanation of neurodevices against patient's will raises several novel ethical and legal problems.•The general rights and duties of patients and investigators are discussed.•Explantation requires free and informed consent that can be withheld at any time.•Calls for novel human rights are examined but ultimately dismissed.•Regulators are called upon to define policy solutions.
